New Hampshire Paid Family and Medical Leave (NH PFML)

The New Hampshire Granite State Paid Family Leave Plan (NH PFML) began on January 1, 2023. The State is providing paid family leave benefits to their state workers and created a paid family and medical leave program to encourage other public and private employers to participate. Individuals who do not have access through their employer’s program can also opt for insured coverage for both paid family leave (PFL) and paid medical leave (PML) benefits.

NH PFML Details 

Group Insurance/Administration: 

Fully Insured (through state approved carrier only): PML and PFL only (An annual BET Tax credit may be available for employers who participate)

Individual Insurance:

If you are a NH worker and your NH employer does not provide NH PFML insurance, or an equivalent benefit plan, you may be eligible to enroll in the NH PFML individual plan.

None. NH PFML does not offer job protection. However, job protection may be provided through other laws such as the federal Family and Medical Leave Act (FMLA).

Group Insurance:

  • Duration: 6 weeks or 12 weeks paid plus a 7-calendar day unpaid elimination period per year
  • 60% wage replacement up to the applicable Social Security taxable wage maximum
  • Flexibility within parameters set by the NH Insurance Department

 Individuals:

  • Duration: 6 weeks paid plus a 7-calendar day unpaid elimination period per year
  • 60% wage replacement, up to the applicable Social Security taxable wage maximum
  • Individuals only: Subject to a 7-month waiting period prior to being eligible to receive NH PFML wage replacement

The State workers would be outlined as follows:

State Workers: 

  • Duration: 6 weeks paid plus a 7-calendar day unpaid elimination period per year
  • 60% wage replacement, up to the applicable Social Security taxable wage maximum
  • State workers: PFL only

Group Insurance and Individual Insurance:

PFL:

  • Child bonding within the first year of birth or placement if adopted or through foster placement
  • Care for a family member with a serious health condition
  • Military exigency or to care for a service member with a serious injury or illness

PML:

Workers own serious health condition

Group Insurance: 

Premiums are set based on the flexibility approved by the NH Insurance Department

Individual Insurance: 

$5 maximum per week or $260 annually as set under the statute

 December 1, 2024 - January 29, 2025:

60-day open enrollment ran for individuals
